Terms of Service

Important: When commissioning me you are expected to read my Terms of Service, and follow it. My ToS can be updated any time. However, during the time you have commissioned me and a change in ToS occurs, the old ToS still applies to you. How do I work? I like to keep in constant contact with commissioner, this will go by e-mail. Why? Because that way I can easily keep track on what has been said, and what you want to have. Not only that, but both of us (you: the commissioner, and me: the one who has been commissioned) will have it on ‘black and white’ and documented in case of anything might happen. As a commissioner, these are the steps you and I will follow during the process of the commissioning. It is important to note that communication is key. I want us both to be happy during the commissioning process: :pointr: Step 1) Request quote. You send me a message (by e-mail) on what you would like to commission me for. Please mention as much details as you can of what you want. I strongly encourage and advise you to send me links and/or images attached in the email of the characters you want to commission me and of any attributes/accessories/landscapes you would like to add into the commission. If you do not have any images readily available, please provide a detailed description of your character. Example images are allowed (for example: an image of boots you saw in a picture somewhere you would like your character to wear). :pointr: Step 2) Receiving answer. I reply back with any questions I might have and/or the price (see standard base prices -here-). Once everything I clear, I will accept or decline the commission. I decline if it is something I do not feel comfortable with drawing (see below for list of things I will and will not draw). Everything must be clear and agreed upon between me and the commissioner before we can proceed to the next step of payment. :pointr: Step 3) Payment. 50%-100% payment upfront, through PayPal or IBAN. The first 50% is not refundable (see below the steps for exceptions). This will give you the ability to receive a sketch from me on which you can provide some criticism. However, big changes to a piece, changing the original details in whatever way, or wanting a lot of numerous changes may result in a ‘dead-end’. A dead-end can also account for radio-silence on the commissioner's side, meaning that I am not receiving any reply of the commissioner passed a reasonable amount of time*. (See below, under notes, for details.) I decide whether a 'dead-end' situation has occured. Dead-end means that I might not continue the commission, and I will reject it. I want the commissioner to be happy with the product, thus I encourage the commissioner to be critical about what he/she might receive. Take your time to make up your mind. :pointr: Step 4) Accepting sketch. When you as the commissioner have accepted the sketch, with any changes that you would like to have, I expect the full 100% payment before I start finalising the product. When having received the full payment I will still stay in full contact with you until the piece is completed and you have received it. (From time to time if I have any questions I will message you.) :pointr: Step 5) Completion. The image will be completed, no more revisions or changes during this stage. The commissioner will receive the .PNG format. If the commissioner would like to have any other file formats, such as to print it out for him/herself, I can always send along a file with provides you this opportunity. *50% not refunded. Exception: If for some reason I cannot complete your commission. I.E.: When the file I work on has in whatever way gone missing, has gotten corrupted, etc. Or any other unexpected situation that might befall on my side that prevents me from completing your commission. In other words: Something neither the commissioner nor the commissioned can do anything about. Full refund will be done if this is the case. Feel free to message me and ask if I can draw something you'd like me to draw. Please understand that my refusal is not me judging you. I simply do not feel comfortable drawing certain things. Check out -here- for other specific examples and their prices. Payment: :bulletblack: 50%-100% payment upfront. :bulletblack: Prices are to be paid in € (Euros). I will not accept payment in any other currencies via (SEPA) bank transfer. :bulletblack: Prices are shown in $ on my current commission price list. At time of payment the current exchange rate will be calculated for how much the price will be in €. :bulletblack: When the commissioner has agreed on the price, this will also mean he/she has read and accepted my ToS. Haggling for a cheaper price after the agreement and payment will not be tolerated. If you do so, I have the right to decline your commission and the payment will not be refunded. I also reserve the right to decline you a commission spot in the future. :bulletblack: I will not increase price later on, unless you want to add certain things to your piece (another character, or huge changes in the piece once shown the sketch concept). :bulletblack: I only accept payments currently through IBAN transaction. If you are outside of SEPA/EU and would prefer other means to pay with, please contact me about this. Other important notes: -Generally I work on a first come, first serve basis. However, if you have a certain deadline in mind (for example Christmas or Valentines) please tell me at once. That way I can tell you whether or not I can finish your piece on time or if there are any extra charges. -If it will take me longer than expected to finish your piece, I will message you. If I can mention an estimate, I will do so. -I always stay in contact with the commissioner during the process. The commissioner and I will both have to reply within a reasonable amount of time. The response time might take up to -Costs for printing and/or shipping are not included in the commission price list. Please message me if you want your commission to be printed and shipped, that way I can include that in the quote. -If you have any questions (regarding my ToS or commissioning me), please note/message me. -I will only give out my email once you have expressed interest in commissioning me (by note/PM). Artist and Commissioner’s rights: -I have the rights to the piece I have created. -I have the right to raise the price depending on difficulty of a character. This includes, but is not limited to: Complicated markings, complicated anatomy, etc. -I have the right to refuse a piece. -I reserve the right to use the commissioned piece I do for any prints, examples, etc. Unless otherwise discussed. -The commissioner keeps any rights of their character, or characters shown in the image. -The commissioner has to right to upload the original piece (with my signature!) to their account/webpage/social media/etc., and they are allowed to use the piece for their own personal use. However credit must always been given by stating: "Created by: Solus Zelt" with a link to my account/website and a link to the original piece that I have uploaded. I would highly appreciate this act. -My signature is not allowed to be taken off any piece. -You do not have the right to sell or distribute my artwork in any shape or form. -You do not have the right to edit or change the image in any way. This includes, but is not limited to: Removing my signature, changing colours of a coloured image, adding text. You may, however, change the size to use as an icon for your own personal use if you are the commissioner of the piece. -You are not allowed to use my pieces for advertisements. Privacy: -I will put your name, nickname, and/or icon (with a link to your account/website if provided) in the description of the uploaded picture, unless you specifically ask me not to do so. In which case you will be listed as 'private'. -Your commission details or any other (personal) details I will not put online, or anywhere else. Nor will this information be shared with any other third parties. This information is between you and I. The only thing that will be seen online is your commission with your (nick)name and/or icon, and if provided a link to your account/website, unless otherwise specified. Summarised: Do not repost any artwork I make unless you fully credit me and link back to my profile/website and link to the original artwork. Editing any artwork is not allowed, nor are you allowed to claim the artwork or any characters I draw as your own. You can only claim the character as your own if you are the creator and owner of the character. You cannot claim the artwork as your own in any case. Any characters I draw belong to their owners respectively. Action will be undertaken if any act goes against the Terms of Service provided here.
